This website and associated services are operated by ScribeJolie.com ("we," "us," "our"). By accessing this website or purchasing our social media content services ("Services"), you ("Client," "you," "your") agree to be bound by these Terms of Service.

If you do not agree to these terms, you may not use our Services.

We reserve the right to update these Terms at any time. Continued use of our Services after changes constitutes acceptance of the modified terms.

 

  1. SERVICES PROVIDED

We provide weekly social media content creation services, including:

 

Text-based social media posts (captions, hashtags, posting schedules)

Optional branded short-form videos (Reels, Stories, etc.)

Content delivered via email or shared folder every Thursday

 

You are responsible for posting the content. We create it; you publish it on your own social media accounts.

We do not:

 

Manage your social media accounts

Respond to comments or messages

Schedule or post content on your behalf (unless separately agreed in writing)

Guarantee specific engagement, follower growth, or business results

 

  1. ELIGIBILITY

You must be at least 18 years old and legally able to enter into binding contracts to use our Services.

By signing up, you represent that all information you provide is accurate and current.

 

  1. PRICING

Current pricing and service plans are available on our website. Prices are subject to change. Price changes apply to new subscriptions and renewals after the change is announced.

 

  1. FREE TRIAL

New clients receive a 2-week free trial with no credit card required.

During the trial:

 

You will receive content as described in your selected plan

No payment is required unless you continue after the trial period

You may cancel anytime before the trial ends with no obligation

 

If you do not cancel before the trial ends, your subscription will automatically begin and your payment method will be charged.

 

  1. BILLING & PAYMENT

Monthly Billing: Services are billed monthly in advance on the date you subscribe.

Payment Methods: We accept major credit cards and other payment methods as displayed at checkout.

Auto-Renewal: Your subscription automatically renews each month unless you cancel before your next billing date.

Failed Payments: If payment fails, we will attempt to process payment up to 3 times. If unsuccessful, your service may be suspended or terminated.

 

  1. CANCELLATION & REFUNDS

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will continue to receive content through the end of the paid period.

 

Refunds:

 

  • Free Trial: No refunds apply as no payment is required during the trial.
  • First Delivery: If you are not satisfied with your first paid delivery of content, request a refund within 7 days of receiving it. We will either revise the content to your satisfaction or issue a full refund.
  • Subsequent Deliveries: No refunds are provided after your first paid delivery. You may cancel anytime to stop future billing.

 

Digital Content: Once content is delivered, it cannot be "returned." Refunds are provided at our sole discretion based on service quality, not client preference.

 

  1. CLIENT RESPONSIBILITIES

You agree to:

 

Provide accurate information about your business, brand voice, and content preferences during onboarding

Respond to our monthly check-ins for CTA updates or content adjustments within 7 days

Post content in accordance with platform terms of service (Facebook, Instagram, Twitter, etc.)

Not resell, redistribute, or white-label our content to third parties without written permission

 

You acknowledge that:

 

Social media engagement depends on many factors outside our control (audience, timing, platform algorithms, etc.)

We are not responsible for how you use the content or any results from posting it

 

  1. INTELLECTUAL PROPERTY

Content Ownership: Once delivered and paid for, you own the content we create for you and may use it freely for your business.

Our Materials: All templates, processes, tools, and methodologies used to create your content remain our intellectual property.

Prohibited Use: You may not:

 

Reverse-engineer our content creation process

Use our content to compete with our Services

Claim our work as your own creation for commercial purposes beyond standard social media posting

 

  1. CONTENT STANDARDS & LIABILITY

AI-Generated Content: We use AI tools combined with human review to create your content. While we strive for quality, we do not guarantee that content will be error-free.

Your Review Responsibility: You are responsible for reviewing all content before posting. We are not liable for errors, typos, factual inaccuracies, or compliance issues that arise from your use of the content.

No Guarantees: We do not guarantee:

 

Specific engagement rates, follower growth, or sales results

Compliance with industry-specific regulations (medical, legal, financial, etc.) unless explicitly agreed in writing

Content will not be flagged or removed by social media platforms

 

Platform Compliance: You are responsible for ensuring posted content complies with the terms of service of Facebook, Instagram, Twitter, and any other platforms you use.

 

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

We are not liable for:

 

Lost profits, revenue, data, or business opportunities

Indirect, incidental, or consequential damages arising from use of our Services

Damages exceeding the amount you paid us in the 3 months prior to the claim

 

Service "As-Is": Our Services are provided "as is" without warranties of any kind, express or implied, including but not limited to merchantability or fitness for a particular purpose.

Force Majeure: We are not liable for delays or failure to perform due to events beyond our reasonable control (internet outages, platform changes, natural disasters, etc.).
